Algumas questões jurídico-laborais do teletrabalho

Abstract

A presente dissertação pretende discorrer sobre alguns dos temas listados nas relações de trabalho subordinadas, habitualmente fora da empresa e através do recurso a tecnologias de informação e de comunicação, vulgo teletrabalho, na sua mais recente versão. Em boa verdade, e por efeito da pandemia causada pelo Covid_19, milhões de pessoas, por todo o mundo, descobriram este regime, tornando-o uma forma de trabalhar normal. Isso é reconhecido de modo bilateral pelos sujeitos laborais, uma vez que muitos (trabalhadores e empregadores) são aqueles que escolhem manter relações de trabalho à distância. Pese embora este regime tenha sofrido já várias alterações significativas, ainda se encontra muito frágil. Se, por um lado, pelos seus benefícios, esta figura pode ser assumida como uma nova e mais inovadora forma de manter e criar relações laborais, por outro, não nos podemos olvidar das suas desvantagens, motivo pelo qual tem sofrido algumas alterações legislativas, tendo em vista uma consolidação e proteção dos bens que visa proteger. Aqueles que laboram a partir do seu seio familiar confrontaram-se, não raras vezes, com a dificuldade de compatibilizar a execução das suas tarefas com a sua vida social e familiar, o que muitas vezes leva à sensação de “violação” de privacidade, confronto com falta de condições para laborar e, consequentemente, o aumento dos níveis de insatisfação. Posto isto, a presente dissertação não pretende fazer definições dos conceitos adjacentes ao regime, mas sim abordá-los com referência à legislação em vigor, trazendo à colação um leque de questões jurídico-laborais, contextualizando-as.

This dissertation aims to discuss some of the issues listed in subordinate employment relationships, usually outside the company and through the use of information and communication technologies, known as telework, in its most recent version. In fact, and as a result of the pandemic caused by Covid_19, millions of people, all over the world, have discovered this regime, making it a normal way of working. This is recognized bilaterally by the labor subjects, since many (workers and employers) are those who choose to maintain remote working relationships. Despite the fact that this regime has already undergone several significant changes, it is still very fragile. If, on the one hand, due to its benefits, this figure can be considered as a new and more innovative way of maintaining and creating labor relations, on the other hand, we cannot forget its disadvantages, which is why it has undergone some legislative changes, with the aim of consolidating and protecting the assets it seeks to protect. Those who work from their families have often faced with the difficulty of reconciling the execution of their tasks with their social and family life, which frequently leads to the feeling of "violation" of privacy, confrontation with lack of conditions to work and, consequently, increased levels of dissatisfaction. Having said that, this dissertation does not intend to make definitions of the concepts adjacent to the regime, but rather to address them with reference to the legislation in force, presenting a range of legal-labor issues, contextualizing them.
